Terms of Service

1. Who We Are and Definitions
Totally Teach Match (the "Platform") is operated by Totally Teach Ltd, a company registered in England and Wales under company number 15260581, with its registered office at Unit 1 Tower Lane, Warmley, Bristol, BS30 8XT, United Kingdom ("Totally Teach", "we", "us"). In these Terms:
- "Teacher" means an individual using the Platform to find teaching opportunities.
- "School" means an educational institution, and the individuals acting on its behalf, using the Platform to find teaching staff.
- "Partner" means a participant in our referral programme.
- "Content" means any information or material you submit to the Platform, including profiles, CVs, documents, photos, videos, references and messages.
- "AI Features" means the artificial-intelligence-assisted tools we provide, including match scores, CV and profile analysis, video transcription and analysis, retention predictions and suggestions.
- "Aggregated Data" means data derived from Content or from use of the Platform that does not identify any individual or any School.
2. Acceptance and Eligibility
By creating an account or using the Platform you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform. You must be at least 18 years old. If you register on behalf of a School, you confirm that you are authorised to bind that institution to these Terms.
3. The Services
3.1 What we are, and what we are not
The Platform is an introduction and decision-support service that connects Teachers and Schools and provides tools to support their recruitment decisions. We are not the employer or the agent of any Teacher or School, and we are not a party to any employment or service contract concluded between them. Any employment relationship exists solely between the Teacher and the School.
3.2 No guarantee of placement or hire
We do not guarantee that any Teacher will receive interviews, offers or employment, or that any School will find suitable candidates, in any volume or timeframe.
3.3 AI-assisted matching: decision support only
Match scores, coherence scores, video analyses, retention predictions and suggestions are probabilistic, AI-assisted indicators produced to support human decision-making. They are not job offers, rankings of personal worth, or hiring decisions. No decision that produces legal or similarly significant effects for you is made solely by automated means: interview and hiring decisions are always made by Schools and Teachers. Our team can review any score or output with you on request, and you may contest an output by contacting us (see Section 9 of the Privacy Policy for your data rights).
3.4 How we use data to run and improve the Platform
We use Content and platform activity (such as match outcomes, interviews and placements) to operate, secure and improve the Services, including calibrating and training our matching algorithms. Improvement of our algorithms relies on pseudonymised or aggregated information, as described in our Privacy Policy. You can object to the use of your data for algorithm improvement at any time by contacting rowena@totallyteach.com.
3.5 Accuracy of profiles
You warrant that all information you provide (including qualifications, certifications, work history and right-to-work information) is accurate, current and not misleading. Providing false information is a material breach of these Terms and may result in immediate termination of your account.
3.6 References
By adding a reference, you confirm that you have that person's permission to share their name and contact details with us and with Schools for recruitment purposes.
3.7 School obligations
Each School warrants that:
- its job postings are genuine, lawful and accurately described;
- its recruitment practices, including any search criteria, filters and preferences it configures on the Platform, comply with the employment, immigration and anti-discrimination laws applicable to the role and to the country of employment;
- it will conduct all pre-employment checks required by applicable law before hiring any candidate.
The School is solely responsible for its selection criteria and hiring decisions.
3.8 Conduct and non-circumvention
You agree to behave professionally in all interactions on or arising from the Platform. Where an introduction between a Teacher and a School is first made through the Platform, the School agrees not to conclude an engagement with that Teacher outside the Platform in order to avoid applicable fees, for a period of 12 months from the introduction. Doing so is a material breach, and the applicable placement fee remains payable.
3.9 Verification limits
We may perform limited screening (such as document review, video screening and AI-assisted checks), but we do not verify and do not guarantee the identity, qualifications, right to work, background or suitability of any user. Schools must carry out their own checks as required by applicable law, and Teachers should independently assess Schools and offers.
4. Your Content and Licence
4.1 Ownership
You retain all rights you hold in your Content.
4.2 Licence to us
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, translate, analyse (including with AI systems and third-party AI providers acting on our behalf) and display your Content, solely to operate, secure, support and improve the Services. This includes, for example, extracting text from your CV, transcribing and analysing videos you upload, and showing your profile to Schools as part of matching.
4.3 Aggregated Data
We may create Aggregated Data from Content and platform activity and use it for any lawful purpose, including improving our matching algorithms and producing statistics. Aggregated Data does not identify you and may be retained after your account is deleted.
4.4 Feedback
If you send us suggestions or feedback, we may use them without restriction or compensation.
5. Acceptable Use
You must not:
- scrape, harvest, copy or index profiles or any Platform data, whether manually or by automated means;
- access the Platform by automated means without our written permission;
- resell, license or otherwise commercialise Platform data, or use profile information for any purpose other than recruitment conducted through the Platform;
- reverse engineer, probe or attempt to extract our algorithms, models or scoring logic;
- circumvent any technical or security measure of the Platform;
- submit content that is unlawful, discriminatory, defamatory or misleading, or impersonate any person or entity;
- harass, abuse or harm other users.
We may suspend or terminate accounts that violate this Section immediately and without notice.
6. Fees, Subscriptions and Payments
6.1 Paid services
Certain features are paid: for Teachers, the CV Builder subscription; for Schools, subscription plans and placement-based fees as agreed. All prices are disclosed before purchase. Payments are processed by Stripe; we do not store card details.
6.2 Subscriptions and renewal
Subscriptions renew automatically (monthly or annually) unless cancelled before the renewal date. You can cancel at any time by contacting us at rowena@totallyteach.com; access continues until the end of the current billing period. Except where required by law, fees already paid are non-refundable.
6.3 Consumer right of withdrawal
If you are a consumer in the United Kingdom or the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving a reason. If you request immediate access to the paid service, you acknowledge that once the service has been fully performed, or to the extent it has been performed, your right of withdrawal is limited accordingly, and a proportionate deduction may be made for the service already provided. 6.4 Taxes
Fees are stated exclusive of applicable taxes unless indicated otherwise.
7. Intellectual Property
The Platform, including its software, design, algorithms, models, scores, databases and Aggregated Data, is owned by Totally Teach or its licensors and is protected by intellectual property laws. These Terms grant you no rights in the Platform other than the limited right to use it in accordance with these Terms.
8. Privacy
Our Privacy Policy explains what personal data we collect, how we use it (including for AI Features and algorithm improvement), who we share it with, and your rights. It is incorporated into these Terms by reference.
9. Third-Party Services
The Platform relies on third-party providers (including hosting, payment processing, email delivery and AI providers). We are not responsible for interruptions or failures attributable to third-party services, though we will use reasonable efforts to restore availability.
10. Disclaimers
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. In particular, we do not warrant that AI Features are accurate, complete or suitable for any specific decision, or that any candidate or role is suitable for you. Nothing in this Section affects rights that consumers have under applicable law.
11. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Consumers retain all rights granted by mandatory consumer protection law.
Subject to the paragraph above: (a) we shall not be liable for indirect or consequential losses, loss of profits, loss of opportunity or loss of data; and (b) our total aggregate liability arising out of or in connection with the Platform shall not exceed the greater of (i) the fees you paid to us in the 12 months preceding the event giving rise to the claim and (ii) 100 GBP.
For clarity, we are not liable for hiring decisions made by Schools, for the conduct of Teachers or Schools, or for the outcome of any employment relationship.
12. Indemnity
You will indemnify and hold Totally Teach harmless from claims, damages and reasonable costs arising from: (a) your breach of these Terms; (b) your Content; (c) your violation of applicable law; and, for Schools, (d) claims arising from your recruitment practices, selection criteria or hiring decisions. This Section applies to consumers only to the extent permitted by applicable law.
13. Suspension and Termination
You may close your account at any time. We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, or if we reasonably consider your use creates legal or security risk. Upon termination, your right to use the Platform ends and your data is handled as described in the Privacy Policy. Sections 4.3, 7, 10, 11, 12 and 15 survive termination.
14. Changes to the Services or These Terms
We may modify the Platform and these Terms. For material changes we will give reasonable advance notice (for example by email or an in-product notice). Continued use after the effective date constitutes acceptance. If you are a consumer and do not accept a material change, you may terminate your account and, where required by law, receive a pro-rata refund of prepaid fees for services not yet provided.
15. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you retain the protection of the mandatory laws of, and the right to bring proceedings in, your country of residence. Before starting formal proceedings, the parties will attempt in good faith to resolve any dispute within 30 days of written notice.
16. General
These Terms, together with the Privacy Policy and any order or plan terms, constitute the entire agreement between you and us regarding the Platform. If a provision is found unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver. We may assign these Terms to a successor of our business; you may not assign them without our consent. Neither party is liable for delays caused by events beyond its reasonable control. The English language version of these Terms prevails over any translation.
